Legality of Salvia Divinorum

At present, Salvia Divinorum has gained legality in most countries and in most states within the US. However, there are still petitions questioning the legality of the usage of this plant. It should be noted that most of these proposals have not been converted into law. In countries such as the United Kingdom and in some states of USA such Illinois, Oregon, Wyoming and Alaska, these petitions are still being reviewed.

There is not enough evidence to prove the adverse effects of Salvia. In this case, it favors Salvia’s legal status around the globe. It is important to note that Salvia is nontoxic and nonaddictive. Countries such as Australia and some American states have established anti-Salvia laws. Politicians from various states have argued that the effects of Salvia are somehow similar to “LSD”. This information alone is sufficient enough to impose prohibition of use of Salvia.

Oppositions of such prohibitive procedures have argued that this measure is a result of intrinsic prejudice and cultural bias rather than presentation of evidence emphasizing inconsistencies in attitudes toward other much toxic drugs such as nicotine. Other territories and States such as Missouri have imposed the strictest Schedule I or equivalent classification against Salvia divinorum, prohibiting the existence of this plant even in its normal and untouched form. On the other hand, most Salvia proponents have argued to impose prohibitive measures on the sale of this substance to minors or the sale of strength-enhanced Salvia in general.

In any Salvia law, there have not been prosecutions being publicized. The regulation of the legislation proves to be a difficult one because this plant does not have distinctive leaves and odor. It appears to be non-descriptive unlike other plants which are considered illicit and illegal like cannabis.
